Friday 10th June 2005

The following is a statement of the Disciplinary Appeals Committee following the hearing at Northern CC on Wednesday 8th June 2005.

1.  MALCOLM SWIFT

The Committee upheld the decision and the recommendation of the Disciplinary Committee to suspend this player for a period of one week. The player is therefore suspended from midnight Friday 10th June to midnight Friday 17th June 2005. served

2.  AINSDALE C.C.

A member club of the L&DCC has a responsibility to behave responsibly within the rules. These rules have been developed over a number of years and in conjunction with ECB and operate to the benefit of clubs and players alike and for the overall good and spirit of the game. We consider it unacceptable that Ainsdale Cricket Club saw fit to respond by taking no action under the Disciplinary Guidelines to an action which was clearly within the guidelines and not within the Spirit of Cricket. Such lack of action brings Ainsdale CC into disrepute in the eyes of L&DCC clubs and the public alike.

The Appeal Committee has therefore imposed a further 2 week suspended sentence on Malcolm Swift. This will obviate the need for the club to be involved in the event of a further Disciplinary Report requiring action. The suspended sentence will apply until the end of the 2006 season and may be applied in total or in part or increased by any future Disciplinary Committee.

In addition Ainsdale CC will forfeit the £50.00 Appeal Fee which was not lodged with the L&DCC prior to the hearing in accordance with the Appeals Procedure. Such an amount will be deducted from Ainsdale CC's share of ECB monies.

In imposing these sanctions the Appeal Committee intends to deter other clubs who may be tempted to act in a similar fashion.

3.  RECOMMENDATIONS FOR THE FUTURE

The two hearings in connection with this incident involved six busy and hard working people who hold responsible positions within the L&DCC.

Walter Armstrong (Chairman of Disciplinary sub Committee)
Anthony Coyne (Northern CC Cricket Chairman)
Malcolm Barber (L&DCC Cricket Chairman)

Chris Weston (L&DCC Hon. Secretary)

Mike Dixon (MCUA)
Ray Rigby (MCUA)

Effectively the expenses involved in scheduling these two Hearings currently fall on the other 25 L&DCC Clubs as payments are made from L&DCC funds. This Appeal Hearing considers this to be unreasonable and has therefore referred this matter to the M/C for review requesting that they question the apportionment of costs in future disciplinary matters and looking for possible rule amendments with regard to this aspect of disciplinary matters.
