Disciplinary Report Action 23 2014 - Chris Foran (Birkenhead Park) and Andrew Watts (Fleetwood Hesketh)
Friday 31st October 2014

Two players have been suspended for a total of ten weeks following an incident in the ECB Premier League fixture during the Fleetwood Hesketh v Birkenhead Park match at Sea Cop on Saturday September 20th.

Hesketh's Andrew Watts and Park player Chris Foran were reported for verbally and physically abusing each other in the second innings of the match which took place on September 20th.

As a result, Birkenhead Park CC has banned Chris Foran for six weeks, commencing at midnight on the Friday immediately preceding the start of the 2015 season.  The club has also given the player a further ban of four weeks suspended until the end of the 2015 season.

Fleetwood Hesketh CC did not support the recommendation of the Disciplinary Committee for disciplinary action against Andrew Watts, which therefore resulted in a Disciplinary Hearing held at Liverpool CC on October 29th.

The Disciplinary Panel gave the player a four week ban commencing at midnight on the Friday immediately preceding the start of the 2015 season, with a further two weeks suspended until the end of the 2015 season. The club has decided not to appeal the decision.

Disciplinary Report Action 22 2014 - Malcolm Swift (Ainsdale)
Wednesday 29th October 2014

The following has been issued today.

Further to all previous correspondence and conversations concerning the above, including the two L&DCC hearings and subsequent e-mails to the ECB and the LCB, this is to inform that the Lancashire Cricket Board has informed the L&DCC of the outcome of their consideration.

They consider that this has been a matter for the League and the Club.  They do not feel the need to take any action and are satisfied that the matter has been dealt with appropriately via our disciplinary processes.

As such the decision taken after the L&DCC hearing on the 24th July 2014 stands.

The outcome and actions of that hearing which will now be implemented are:

1. the activation of Malcolm Swift's existing two week suspended suspension, and

2. a further two week additional suspension for his comments on Twitter.

The suspensions will begin at midnight on Friday 17th April 2015 and run consecutively to midnight on Friday 15th May 2015.

Disciplinary Report Agreed Action 21 2014 - Simon Pearce (Southport and Birkdale)
Friday 10th October 2014

A complaint was received following an incident at Southport & Birkdale CC on 16th August.

The player, Simon Pearce a playing member at S&B, posted 'tweets' on his Twitter account which were also sent to Maghull CC's Twitter website. The 'tweets' were considered to be offensive and a complaint was lodged with the L&DCC. The player refused to apologise for these 'tweets' and the club also refused to take any action.

A Disciplinary Hearing took place on 25th September and the matter was dealt with in his absence and regrettably without any representation from the club. The Panel agreed that the 'tweets' were abusive and Simon Pearce is banned from playing cricket for two weeks commencing at midnight on the Friday immediately before the start of the 2015 season. In addition a two week ban suspended until the end of the 2015 season was also imposed. The club has not appealed this decision.

The misuse of 'Twitter' has led to several similar disciplinary bans this season and all clubs and players are reminded that such misuse, which is expressly condemned by ECB, will be dealt with severely in future."
